Who processes your data?

The controller of your personal data is Przemysław Rudnik, running a business under the name CAASUAL – Przemysław Rudnik, hereinafter referred to as “CAASUAL”. For any matters concerning your personal data, write to us at weare@caasual.pl.

What data do we process?

We process the data you provide when you contact us, including when you sign up for a free consultation via the form on our website or by email: your email address and, if you provide them, your name and the content of your message. If you give consent in the cookie banner, analytics and advertising tools also collect information about your device and how you use the website (details in the cookie policy below).

Providing your data is voluntary, but without an email address we cannot reply to your enquiry or schedule a consultation.

Why do we process your data?

Processing your data allows us to provide our services, including scheduling online consultations, organizing on-site meetings, sending offers, and communicating with you regarding cooperation or recruitment.

In particular, we process your personal data:

– to reply to your enquiry, schedule a consultation and prepare an offer, i.e. to take steps at your request before entering into a contract. The legal basis for processing is Article 6(1)(b) of the GDPR;

– for the purpose of performing a service agreement (including settlements and communications related to service delivery). The legal basis for processing is the necessity to perform a contract (Article 6(1)(b) of the GDPR);

– for the purpose of handling complaints and any potential claims. The legal basis for processing is CAASUAL’s legitimate interest (Article 6(1)(f) of the GDPR), consisting of securing information about cooperation (including, among others, your payment history and communication with us) to handle potential claims;

– for analytical or statistical purposes. The legal basis for processing is CAASUAL’s legitimate interest (Article 6(1)(f) of the GDPR), consisting of using financial and sales analyses for internal reporting and determining optimal directions for our business development;

– to measure website traffic and tailor ads using cookies (Google Analytics, Microsoft Clarity, Meta Pixel). The legal basis for processing is your consent given in the cookie banner (Article 6(1)(a) of the GDPR).

How long do we store your data?

We keep data only for as long as necessary:

– data from an enquiry that did not lead to cooperation – for 12 months from the last contact, after which we delete it,
– data related to a contract – for the duration of the contract and then until the limitation period for claims under the contract expires,
– accounting documents (e.g. invoices) – for 5 years from the end of the calendar year in which the tax payment deadline expired, as required by Polish tax law,
– data processed on the basis of consent (analytics and advertising cookies) – until you withdraw your consent, but no longer than the retention period set in the given tool (in Google Analytics, no longer than 14 months from your last visit).

You may withdraw your consent at any time – click “Cookie settings” in the website footer or write to weare@caasual.pl. Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

Who do we share your data with?

In connection with the services provided to CAASUAL by external entities, those entities may have access to your personal data to the extent necessary to perform such services. These entities include providers of IT, legal, or accounting systems and services.

Some of these entities — Google (Google Analytics), Microsoft (Microsoft Clarity) and Meta (Meta Pixel) — may process data outside the European Economic Area, including in the United States. Such transfers are based on the European Commission’s adequacy decision under the EU-US Data Privacy Framework, in which these companies participate, or on standard contractual clauses approved by the European Commission (Articles 45 and 46 GDPR). Cookies of these tools are stored only after you give consent in the cookie banner.

Messages sent through the form on our website are stored in the HubSpot CRM (HubSpot Ireland Ltd.), which we use to manage client contacts. The data is stored in HubSpot’s data centre in the European Union, but HubSpot may make it available to its affiliates in the United States (e.g. for technical support) under the EU-US Data Privacy Framework or standard contractual clauses. HubSpot privacy policy: https://legal.hubspot.com/privacy-policy.

What are your rights?

In connection with the processing of your data by CAASUAL, you are entitled to several rights:

– You may obtain information on how and to what extent we process your data, as well as a copy of your personal data. If your request includes a copy of data, please specify which data you wish to receive. CAASUAL may charge a fee for the second and any subsequent copies, of which you will be notified. The fee will reflect the cost of preparing the copy;

– You may request the rectification of your data (if recorded incorrectly or changed), deletion (if there is no legal basis for CAASUAL to process it), or restriction of processing (if you wish CAASUAL to process your data only to a limited extent until your objection or rectification request is addressed, or if you wish the data to be retained in connection with your claims);

– You may request the transfer of your data that you have provided to us, in a structured, commonly used, machine-readable format. You may then independently transfer the received data to an administrator of your choice. Additionally, if technically feasible and subject to appropriate security standards, we may do this for you at your request.

– If the processing of your data by CAASUAL is based on legitimate interest, you may object to such processing (information on the legal basis for processing can be found above in the “Why do we process your data?” section).

– If we process your data on the basis of consent, you may withdraw it at any time.

– You have the right to lodge a complaint with the Polish supervisory authority, the President of the Personal Data Protection Office (UODO, uodo.gov.pl), or with the supervisory authority in the EU country where you live or work, if you believe that we process your data unlawfully.

To exercise your rights, write to weare@caasual.pl. We do not make decisions about you based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.
